On finding a tenant who is accepted by you, or whom you have given us or our assignees authority to accept on your behalf, and who completes the Tenancy Agreement, our commission will be charged follows:

Let Only Service

6 % +vat of the gross rent for the period of the agreed tenancy term (applies for the 1st year of all new tenancies). The full fee is payable at the commencement of the tenancy for the agreed tenancy period.

Rent Collection Service

8 % +vat of the gross rent for the period of the agreed tenancy term. The fee is payable monthly from the monthly rent. This fee is payable for the full term of the tenancy and for any extensions or renewals.

Commission is payable on renewal of tenancy or any extensions (after the 1st year) at 5% +vat for the remainder of the tenancy (5% +vat only applicable to the Let only Service). This fee is payable in advance. Should the tenancy roll over or become a periodic tenancy then the fees will be chargeable every 3 months in advance.

The total commission amount is payable at the commencement of each tenancy and/or extension.

Fees remain due and payable should the landlord dispense with the services of the agent during the Tenancy.

If a tenant is found for the property and suitable references have been obtained under the landlords instructions and the landlord does not proceed with the letting for whatsoever reason then a fee of £600.00 is payable by the Landlord to the Agency.

A fee of £250.00 will be chargeable should the agent have to attend court on behalf of the landlord for any reason.

Full Management Service

10 % + vat of the gross rent for the period of the agreed tenancy term (The fee is payable MONTHLY FROM THE MONTHLY RENT.

Commission is payable on renewal of tenancy or any extensions AT THE SAME RATE AS ABOVE. This fee is payable IN ADVANCE/MONTHLY FROM THE MONTHLY RENT. Should the tenancy roll over or become a periodic tenancy then the fees will be chargeable monthly from the monthly rent.

Fees remain due and payable should the landlord dispense with the services of the agent during the Tenancy.

If a tenant is found for the property and suitable references have been obtained under the landlord’s instructions and the landlord does not proceed with the letting for any reason a fee of £600.00 applies.

A fee of £150.00 will be chargeable should the agent have to attend court on behalf of the landlord for any reason.

Preparation and submission of rent statements. Additional copies of monthly statements will be charged at £5.00 per statement.

Inventories

Arrange and co-ordinate the Tenants occupation and vacation of the premises. Organise the check-in and check-out of tenants from the property. The Landlord is responsible for the charges of the inventory compilation & the check in and the Tenant should pay for the check out.

We will instruct an established independent inventory clerk on your behalf when you accept responsibility for their charges. Whilst care is taken in giving instructions to Inventory Clerks, we cannot accept liability for any error or omission on their part.

Unfurnished/furnished Tenancy Agreement and Charges

Unless we are instructed otherwise we use our standard form of Tenancy Agreement in respect of all lettings. Our charge to the landlord for this form of agreement is £120.00. This fee is chargeable for each tenancy agreement provided, whether it is the initial agreement or any renewal agreements. If alterations are made to our standard agreement whether by you or tenant we reserve the right to charge a fee of £60.00 for the alterations made.

Deposit

Except where otherwise provided in writing, the Agent shall hold the deposit in accordance with the provisions of the Tenancy Deposit Schemes as set out in the Housing Act 2004. Such deposit shall be the equivalent of 1- 1.5 months rent. The Agent will within thirty days of the signing of the Tenancy Agreement (or such other period as shall be prescribed by legislation) subscribe to one of the designated Tenancy Deposit Schemes and within such period shall provide to the Landlord and to the Landlord's tenant full details of the scheme including such other information as may be reasonably required.

After the determination of the Tenancy the Landlord shall use his best endeavors to agree with his tenant what deductions should be made from the deposit and will in any event within ten days of the termination of the Tenancy notify the Agent of what sums/issues remain in dispute.

The Agent will, as soon as reasonably practicable after such notification, refer the dispute to the Administrator of the Tenancy Deposit Scheme subscribed to who will then determine matters in accordance with the provisions of that scheme. The Landlord agrees to provide such co-operation as is reasonably required to assist in such a referral and the determination of any dispute. This obligation does not in any way limit the Landlord’s right to make an application to the County Court where appropriate.

A fee of £120.00 will be chargeable by P.A Jones Property Solutions to the Landlord if a Tenancy dispute arises. This will contribute towards the time taken in preparing the dispute documents and postage.

A fee of £60.00 is chargeable by P.A Jones Property Solutions for the administration and registration of the deposit to one of the nominated schemes. A further fee of £24.00 is chargeable upon the renewal of any tenancy for the re-registration of the deposit.

Except with the consent of the Landlord’s tenant or where there has been a determination made by the relevant Tenancy Deposit Scheme or by a Court of Law, the Landlord accepts that notwithstanding the terms of his Tenancy Agreement, no deductions will be made from the deposit and that he will not be entitled to claim interest thereon.

If we are/ the Agent is instructed by you/the Landlord to hold the Deposit, we/ the Agent shall do so under the Terms of the Tenancy Deposit Scheme. The Agent holds tenancy deposits as Stakeholder.

Section 21 Notice

We can serve a Section 21 Notice on your behalf. The charge for this is £60.00.

This is required to obtain possession of the property during an Assured Shorthold Tenancy to expire no earlier than the end of the fixed term or in line with the break clause. Please note, the notice must be served at least 2 months prior to the expiry of any fixed term from a rent due date. If the Tenancy is periodic, at least 2 tenancy periods notice must be given.

Management Service- Property Inspections

We will provide property visits every three to six months whilst the tenant(s) are in occupation, with a written report charged at the following rates per visit:

Studios & 1 Bedrooms: £42.00
2 Bedroom Properties: £54.00
3 Bedroom Properties: £60.00
4 Bedrooms and Larger Houses: £72.00

The report will list any problems that have arisen and action which needs to be taken. Arrange for appropriate tradesmen to effect necessary repairs and decoration to a maximum cost of £200.00 for repairs. In excess of this amount, we will obtain your approval first, except in cases of emergency. An administration cost will be included in the cost of all works arranged by P.A Jones Property Solutions. We will not be responsible for any damage caused by the negligence or failure of a Tradesman who have been instructed by the Landlord.

A management float of £200.00 will be held at the outset of the tenancy, in order for the agency to have sufficient funds to organise any works (if & when required).

Additional Services

A minimum of £240.00 PER MONTH is chargeable on a pro-rata basis for a Caretaking Service for empty or vacant periods when the property has no tenants in occupation. P.A Jones Property Solutions can only offer this service if they are instructed as Sole Agent. Details of the Caretaking duties will be provided if you opt in for this service. Please advise whether this service is required.

Energy Performance Certificate

The landlord will fully comply with the The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007 or amendments that may apply during the period of any tenancy plus any other regulations referred to within this agreement or that may apply at any time. We reserve the right to withdraw our services in respect of any Property that does not comply.

P.A Jones Property Solutions can instruct an Energy Assessor that can carry this out. The current charges are: £84.00 for flats and £96.00 for houses with 3 bedrooms or less. Any 4 bedroom or larger houses will have to be agreed independently and will be charged in accordance of size and number of rooms.

Additional Charges Payable to the Agent.

The cost of any overseas calls faxes and redirected of mail on behalf of the landlord shall be recoverable. There will be an annual charge of £36.00 for all correspondence to overseas Landlords. The Agency reserves the right to increase this fee if necessary.
